Maternity and Adoption Rights

This table is a summary of employees' entitlements to Ordinary Maternity/Adoption Leave (OML/OAL), Additional Maternity/Adoption Leave (AML/AAL) and Statutory Maternity/Adoption Pay (SMP/SAP) including how much notice they have to give you. Employees may be entitled to longer periods of leave or higher payments where this is specified in their contract of employment.

OML/OAL

All pregnant or adopting employees qualify for OML or OAL.

26 weeks' leave. 

Notify employer before the end of 15th week before the week the baby is due or when notification of matching is recieved.

AML/AAL 

All pregnant or adopting employees qualify for AML or AAL.

26 weeks' leave beginning immediately after the end of OML or OAL.

AML/AAL follows on from OML/OAL. No separate notice is required.

SMP/SAP

Pregnant or adopting employees earning at least £90 per week with 26 weeks' continuous service with their employer into the 15th week before the week the baby is due or notification of matching is recieved.

39 weeks paid leave. The first six weeks will be paid at 90 per cent of her average weekly earnings and lesser of £124.88 or 90 per cent of her average weekly earnings for the next 33 weeks.

Notify employer 28 days before the start of SMP/SAP. Can be done at the same time as notification for OML/OAL (above).

 

Paternity Rights

This table is a summary of employees' entitlements to Statutory Paternity Leave (SPL) and Statutory Paternity Pay (SPP) including how much notice they have to give you. Employees may be entitled to longer periods of leave or higher payments where this is specified in their contract of employment.

SPL

An employee whos wife, civil partner or partner is giving birth or adopting and has 26 weeks continuous service by the week that falls 15 weeks before the week in which the child is expected or notification of matching.

One period of up to two weeks paid leave.

Notify employer before the end of 15th week before the week the baby is due or when they receive notification of matching.

       

SPP

An employee whos wife, civil partner or partner is giving birth or adopting and has 26 weeks continuous service by the week that falls 15 weeks before the week in which the child is expected or notification of matching.

Paid at a rate of £124.88 or 90% of their average weekly earnings, whichever is less.

Notify employer before the end of 15th week before the week the baby is due or when they receive notification of matching.
